AUTOS – REGISTRATION

AB 318 (Chap. 235); amends Veh Section 4750.1

Background: There have been prosecutions involving cases where car dealers and companies have provided car buyers false information that allows purchased vehicles to be undervalued for registration purposes. It is estimated that at least 70,000 vehicles in California have been fraudulently titled, costing the state approximately $385 million in revenue. Additionally, thousands of cars have evaded required smog checks.

In response to this widespread titling fraud and smog check evasion, plus several investigations by the California Attorney General, the legislature enacted legislation in 2008 to grant amnesty to people who owned “misrepresented” vehicles if they did the following by December 31, 2010:

  • Filed an amnesty application
  • Correctly registered the vehicle
  • Had the vehicle pass a smog check
  • Paid all fees and penalties

The 2008 law was not implemented because it did not provide funding to cover costs incurred by Bureau of Automotive Repair (BAR).

The new law: Authorizes BAR to charge a fee to cover its costs, enabling the program to proceed.
