LIENS AGAINST OUT-OF-STATE COMPANIES
AB 1549 (Chap. 153) amends CCP sections 697.530, 697.590, and 700.140
Background: A 2001 revision to the Commercial Code practically eliminated the ability of a judgment creditor to obtain a judgment lien against the assets of a foreign registered organization (corporation, limited liability company) because the conditions for the creation of the judgment lien became impossible to meet.
The new law: Reinstates the ability of judgment creditors to obtain judgment liens against the assets of foreign registered organizations.
